Our proposal for home closing disclosure and changes to the Contract to Buy and Sell Real Estate
Home sellers are required to provide the home buyer and Title Company with HOA documentation as defined by Section 7 in the Contract to Buy and Sell Real Estate. (DORA document listing w/Section 7). This process is called a Transfer Fee service and/or Status Letter. All documentation by law is available to the home seller for no cost (other than reproduction and mailing cost recovery). Home sellers pay a management company to maintain this information via HOA dues and NO charges should be assessed to obtain this information when selling a home to complete Transfer Fee tasks. However, mangement companies are allowed to charge homeowners on average $350 up to $1,000 for this information!
Get all HOA documentation related to HOA home sale transfer fees (home closing), do it yourself and save on average $350: 1) print/download from your HOA's web site or 2) request the property management company provide your realtor on-line access to the documents. These are the same documents that you pay the management company$350+ to obtain: there is no difference.
